Exhaust's release has been marred with issues concerning Phillip Morris, the parent company of Marlboro cigarettes. Because the design of the toy resembles the trade dress of Marlboro, Phillip Morris sent out cease & desist orders to many retailers across the US, Europe, and Asia, preventing the toy from being sold by importers in those regions. This was upheld even in spite of Takara-Tomy altering the deco slightly to reduce the resemblance, and for a time, rumor was Exhaust would not see a release. He did, in the end, but was only available in Japan and from those retailers who were based in Japan and would ship overseas.
